EPO Changes Official Fees

The EPO has announced several changes in official fees from 1st April 2018, although the majority of fees will remain unchanged.  For all European patent applications:

  • A €30 filing fee reduction and a €100 grant fee reduction if the required documents are filed  online in character-coded format.
  • The appeal fee will increase to €2255 for most corporate appellants. It will remain at €1880 for natural persons, small or medium sized enterprises, non-profit organisations and universities or  public research organisations.
  • The third year renewal fee can be paid up to six months before it falls due. The amount of the fee does not change.

This last change allows most PCT applicants to pay the third year renewal fee upon entry into the European Regional Phase, which was not previously possible.

For PCT applications where the EPO is the International Search Authority (ISA):

  • The international search, and preliminary examination fees are reduced by €100 each.
  • There is no transmittal fee if the application is filed online in character-coded format. 

For PCT applications entering the European Regional Phase:

  • If the EPO has conducted a PCT Chapter II examination by the EPO, the examination fee will be reduced by 75% on entry into the European Regional Phase.
  • The European search fee will no longer be reduced when the ISA was the USPTO, JPO, KIPO, SIPO, Russian Federation Intellectual Property Office or the Australian Patent Office.
